These Terms of Service ("Terms") govern your use of SiteWatch Alerts (the "Service"), operated by Streamline Systems, a sole proprietorship owned by Elion Salihu ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
SiteWatch Alerts monitors websites you provide to us for uptime, SSL certificate expiration, domain expiration, page load performance, and the reachability of checkout and contact pages, and notifies you of issues we detect. The Service is provided on a best-effort basis. We do not guarantee that every issue will be detected, that detection will be instantaneous, or that our monitoring itself will be available without interruption.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You're responsible for all activity that happens under your account. Notify us immediately if you believe your account has been compromised.
A single account belongs to one business at a time. Multiple users may be linked to the same business through a share code, at the discretion of that business's account owner.
If you choose to verify a phone number with us, you may opt in to receive text messages from SiteWatch Alerts (Streamline Systems), sent from (224) 268-0063: two-factor login verification codes if you turn on text-message login verification, and/or website alert notifications if you turn on text alerts for a site, depending on which of those you enable in your account. Opting in requires entering your phone number and affirmatively checking a consent box describing these message types; consent to receive text messages is never a condition of purchasing or using any paid plan.
Message frequency varies depending on your account activity and which message types you've enabled. Message and data rates may apply. You can opt out at any time by replying STOP to any message you receive from us, or by removing your phone number from your account; reply HELP to any message for assistance. See our Privacy Policy for more detail on how we collect and handle phone number and messaging data.
Paid plans are billed on a recurring basis (monthly, unless otherwise stated) through our payment processor. By subscribing, you authorize us to charge your payment method on each billing cycle until you cancel.
You may cancel your subscription at any time. Cancellation stops future billing; it does not entitle you to a refund of amounts already paid, except where required by law.
If you enter an incorrect business name during setup, contact us and we'll correct it. If you enter an incorrect website, checkout page, or contact page URL, you can update it yourself at any time from your dashboard. Since both of these are correctable without loss of service, they do not qualify for a refund.
If a payment fails and isn't resolved within a reasonable period, we may suspend or downgrade your access to paid features. Monitoring of your existing sites may continue at our discretion even during a lapsed payment period, but alerts and reports will not be sent until payment is current.
You agree not to: use the Service for any unlawful purpose; attempt to interfere with, disrupt, or gain unauthorized access to the Service or its infrastructure; use the Service to monitor a website you don't own or have explicit authorization to monitor; resell or provide the Service to third parties without our written agreement; or use the Service in a way that places excessive, abusive load on our systems.
By you: You may stop using the Service and cancel your subscription at any time through your account dashboard or by contacting us.
By us: We may suspend or terminate your account, with or without notice, if you violate these Terms, fail to pay amounts owed, use the Service in a way that creates risk or legal exposure for us or others, or if we reasonably believe termination is necessary to protect the Service or other users. Where practical, we'll attempt to notify you of the reason.
Upon termination for any reason: your access to the Service ends, any active subscription is cancelled and future billing stops, and your data is handled as described in our Privacy Policy, including eventual deletion.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that the Service will detect every issue affecting your website, that detection will happen within any specific timeframe, or that our own systems will be free from downtime, errors, or interruption. Monitoring checks run at intervals, not continuously in real time, and issues occurring between checks may not be detected immediately or at all.
You remain solely responsible for the operation, security, and maintenance of your own website. The Service is a monitoring aid, not a substitute for your own oversight of your website and hosting infrastructure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMLINE SYSTEMS AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING DAMAGES RESULTING FROM AN ISSUE WE FAILED TO DETECT OR REPORT.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold Streamline Systems harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your monitoring of a website you weren't authorized to monitor.
The Service, including its software, design, and content, is owned by Streamline Systems. These Terms don't grant you any rights to our intellectual property beyond what's necessary to use the Service as intended. You retain ownership of the data about your own website that you provide to us. By using the Service, you grant us a limited license to access, store, and process that data solely as necessary to provide the Service to you.
Force majeure: We won't be liable for any failure or delay in performance caused by events outside our reasonable control, including internet or infrastructure outages, natural disasters, or failures of third-party service providers we rely on.
Assignment: You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements or understandings.
No waiver: Our failure to enforce any provision of these Terms at any time doesn't waive our right to enforce it later.
We may update these Terms from time to time. If changes are material, we'll make reasonable efforts to notify you (such as by email). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Illinois, and you consent to their jurisdiction.
